These terms and conditions (“Terms and Conditions”) apply to your access and use of content and programs that are provided to you on these National Comprehensive Cancer Network (“NCCN”) websites (“Sites”) including, without limitation, the JNCCN—Journal of the National Comprehensive Cancer Network (“JNCCN”) and JNCCN 360. The “Content” shall refer to journal articles, news stories, podcasts, videos, graphics, articles, or journal issue available for download or access through https://jnccn.org or http://jnccn360.org.

Harborside Press, LLC, (“Harborside”) publishes JNCCN under an agreement with NCCN.

By accessing this Content, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not view, access, or use the Content in any manner.

Using the Content

Ownership of the Content

You acknowledge that NCCN and licensors that provide content and programs for the Content (“NCCN Licensors”) are the owners of all right, title, and interest in and to the Content including, without limitation, all modifications, updates, and other derivative works thereof and all copyright and other intellectual property rights related thereto. Except for the limited rights expressly set forth in these Terms and Conditions, you hereby agree that you shall not at any time dispute, challenge, or contest, directly or indirectly, NCCN's or the NCCN Licensors’ right, title, and interest in and to the Content, or assist or aid others to do so.

Use of the Content

You may print or download the Content for your own personal, non-commercial, informational, or scholarly use.

Prohibited Activities

You may not copy, transfer, reproduce, modify, or create derivative works of any part of the NCCN Content for any reason and may not use the NCCN Content for any commercial purpose. You may not save copies of the purchased Content to devices or media to which other individuals have access, including intranets or extranets or other publicly accessible networks; pass on or send the Content to third parties either in electronic file format or printed format; or lend Content out or otherwise circulate it to others. You may not access or use, or attempt to access or use, the Content to take any action that could harm NCCN, NCCN Members, NCCN Licensors, Harborside, or a third party. You may not use the Content in violation of applicable laws or in violation of any party’s intellectual property of other legal rights.

Without NCCN’s prior written consent, you shall not:

4. Take any action that imposes an unreasonable or disproportionately large load on the network or infrastructure.
5. Do anything that could disable or change the functioning or appearance of the Sites.

NCCN retains all goodwill and intellectual property rights in such Marks. In addition, you recognize that HARBORSIDE® and HARBORSIDE PRESS® are trademarks (“Harborside Marks”) of Harborside. Harborside retains all goodwill and intellectual property rights in such Harborside Marks.

Any use of these NCCN Marks or Harborside Marks in connection with the sale, offering for sale, distribution, or advertising of any goods or services, which is likely to cause confusion, to cause mistake, or to deceive, is strictly prohibited.

Purchasing Content

The term “Customer” shall refer to the individual making the online purchase of content. Customers wanting to purchase Content must first sign up for individual membership of the site (the “Account”). Customers will be prompted to do this or sign in when they start the purchase process. This personal user account is free and, in addition to allowing the purchase of Content, allows users to save JNCCN site search results and see lists of recently viewed or saved content.

Use of purchased content is exclusively permitted for the Customer’s own personal purposes and is subject to the rules set forth in these Terms and Conditions.

Accessing Purchased Content

After purchasing Content, Customers can download the Content in PDF format, or where PDF format is not available, the Customer can access and view or print the content in XML format through a web browser where available. To access the Content, the Customer must be logged into their personal Account. The purchased Content can then be accessed directly on the Content hosting page and any PDF download by clicking the download button. The Content will continue to be available to the user and can be accessed through the Customer’s Account at a later date for at least one month after the purchase date.

To purchase and access Content the Customer requires standard Internet access, a standard internet browser program, and a program for viewing PDF files.

Links

The Sites contain links to third-party websites, resources, and advertisers (“Linked Content”). NCCN and Harborside do not control, endorse, sponsor, recommend, or otherwise accept responsibility for this Linked Content. Transactions that occur between you and any third-party are strictly between you and the third party and are not the responsibility of NCCN or Harborside.

Warranties and Liability

The Content is intended for educational, informational, research, and reference purposes only. The Content does not constitute medical advice and should not be used in place of seeking professional medical advice, diagnosis, or treatment by licensed practitioners.

NCCN, NCCN LICENSORS, AND HARBORSIDE MAKE NO WARRANTIES CONCERNING THE CONTENT, WHICH IS PROVIDED “AS IS.” NCCN, NCCN LICENSORS, AND HARBORSIDE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. IN NO EVENT SHALL NCCN, NCCN MEMBERS, NCCN LICENSORS, OR HARBORSIDE BE LIABLE FOR ANY DAMAGES OF ANY KIND INCLUDING DIRECT, INCIDENTAL, INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND CONDITIONS OR USE OF THE CONTENT INCLUDING, WITHOUT LIMITATION, LOSS OF LIFE, PHYSICAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF INCOME OR PROFIT, OR ANY OTHER DAMAGES, LOSSES, OR CLAIMS, EVEN IF NCCN, NCCN MEMBERS, NCCN LICENSORS, OR HARBORSIDE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, LOSSES, OR CLAIMS.

Registration and Security

Registration data and other information about you and your use of the Sites are subject to the JNCCN Privacy Policy.

If you use a password to access the Sites, you must not reveal your password and must take reasonable steps to keep your password confidential and secure. You agree to notify NCCN and Harborside if you have reason to believe there is an unauthorized use of your password or account.

About the Terms and Conditions

Term and Termination

NCCN reserves the right to modify, suspend, or terminate the Content or the Sites and/or your access to them with or without notice. NCCN and Harborside will not be liable to you or any third party if the Content or Sites are unavailable at any time or for any period. If you are dissatisfied with the Content or the Sites, your sole and exclusive remedy is to discontinue use of the Content or Sites.

Export Controls

You agree that the Content will not be shipped, transferred, or exported into any country or used in any manner prohibited by the United States Export Administration Act, or any other export laws, regulations, or restrictions.

Compliance with Laws

If you access the Content or Sites, you do so on your own initiative and agree to comply with all applicable laws of your home nation, state, or municipality while using the Content or Sites.

Governing Laws and Venues

These Terms and Conditions will be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania without giving any effect to the conflict of law provisions thereof, and each party agrees to submit to personal jurisdiction in the federal and state courts of Pennsylvania and waives any objection to venues in said courts.

Modification

NCCN reserves the right to modify these Terms and Conditions at any time. Revised terms will be posted directly to this page with an effective date of the revision. It is the user’s responsibility to monitor and review updates to these Terms and Conditions. Continued use of the Content will be considered acceptance to the updates of the Terms and Conditions.
